Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
1. Accounts
When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
2. User Content and Data Collection
Our Service allows you to upload or provide certain information, including your resume, job descriptions, text answers, and voice recordings ("User Content"). You are responsible for the User Content that you provide to the Service, including its legality, reliability, and appropriateness.
By submitting User Content to the Service, you grant us the right and license to use, process, store, and analyze this content for the sole purpose of providing and improving the Service. This includes:
- Resumes and Job Descriptions: We analyze these documents to generate personalized study plans and interview questions.
- Voice Recordings: If you use the voice answer feature, we process your recordings to transcribe them into text and perform speech analysis (e.g., words per minute, filler words). Your voice recordings are stored securely on our servers to allow for playback in your session reports.
- Text Answers and AI Feedback: Your answers and the AI-generated feedback are stored to create your session reports and track your performance over time.
You represent and warrant that you have the right to submit the User Content and that it does not violate any third-party rights. We are committed to protecting your data and will not share your personal User Content with third parties except as required to provide the Service (e.g., with our AI service providers under strict confidentiality agreements) or as required by law.
3. Use of AI Services
The Service uses generative artificial intelligence (AI) models to provide features like question generation, feedback, and content analysis. You acknowledge that:
- AI-generated content may not always be accurate, complete, or suitable for your specific needs. It is provided for guidance and practice purposes only.
- We do not guarantee that the advice or feedback provided by the AI will result in a job offer or any specific career outcome.
- You should not rely solely on AI-generated content for making critical career decisions.
4. Prohibited Data
You agree not to upload, post, or otherwise transmit any content that contains the sensitive personal data of others. This includes, but is not limited to, uploading fake resumes containing real people's names, contact information, or private history without their explicit consent.
We reserve the right to remove any content that violates this policy and to terminate the accounts of users who repeatedly violate this provision.
5. Prohibited Uses and Compliance with Law
You agree that you will not use, and will not encourage or assist others to use, the Service for any illegal, illicit, or unauthorized purpose.
Smart Mock Interview owners and operators assume no responsibility for any legal proceedings or damages resulting from your use of the Service for unlawful activities. Use of the Service to generate, analyze, or process content for illegal purposes (including but not limited to fraud, identity theft, or harassment) is strictly prohibited.
We reserve the right to cooperate fully with law enforcement authorities and will share all available data (including User Content, activity logs, and personal information) with relevant authorities if compelled by law or if we have a good faith belief that such action is reasonably necessary to comply with legal process, enforce these Terms, or protect the rights, property, or safety of our company, our users, or the public.
6. Subscriptions and Payments
Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle").
All fees are non-refundable except as required by law or as explicitly stated in our refund policy.
7. Intellectual Property
The Service and its original content (excluding User Content), features and functionality are and will remain the exclusive property of our company and its licensors.
8. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.
9. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
9.1 No Professional Advice or Guarantee of Results
The Service, including all AI-generated feedback, interview questions, and scoring, is provided for informational and training purposes only. It is not intended to substitute for professional career counseling, recruitment advice, or legal advice. Smart Mock Interview does not guarantee that using the Service will result in a job offer, interview, or any specific employment outcome. You acknowledge that AI systems may occasionally produce incorrect or misleading information ("hallucinations") and you agree to verify any critical information independently.
9.2 "As Is" and "As Available"
To the fullest extent permitted by law, the Service is provided on an "AS IS" and "AS AVAILABLE" basis. Smart Mock Interview explicitly disclaims all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
9.3 Limitation of Liability
You expressly understand and agree that Smart Mock Interview (and its owners, employees, agents, and affiliates) shall not be liable to you for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to:
- Damages for loss of profits, goodwill, use, data, or other intangible losses.
- The cost of procurement of substitute goods or services.
- Any loss or damage resulting from your use of (or inability to use) the AI-generated feedback.
- Unauthorized access to or alteration of your transmissions or data.
9.4 Monetary Cap on Liability
Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Smart Mock Interview for the Service during the twelve (12) months prior to the claim, or €100 (One Hundred Euro), whichever is greater.

11. Changes
